Terms & Conditions of Business
Your Instructor
Your Instructor is a self employed franchisee of ‘Zodiac Driver Training’ and is bound by a professional code of conduct published and enforced by DSA. The Instructor will at all times, to the best of their ability, endeavour to teach you correct driving skills according to DSA’s recommended syllabus. The contract for driving tuition is solely between you and Your Instructor. You and Your Instructor are responsible for agreeing all matters relating to the timing, location and duration of individual lessons.
You must notify Your Instructor of any matters which affect your ability or entitlement to having driving tuition, for example, but not limited to, any lack, or loss, of a valid provisional licence, any illness or prescribed drugs which may affect your driving ability.
Your Instructor will be courteous, polite and punctual. Your Instructors car will be well maintained, clean and tidy. All cars used by ‘Zodiac Driver Training’ Instructors’ are fitted with dual controls as part of their standard equipment. The cars are fully insured for driving tuition. ‘Zodiac’ Instructors will not smoke in the car, nor will they use your lesson time for any other form of business, personal or otherwise.
Monies
The Instructor will safeguard and account for any monies paid in advance by the pupil and will make details available on request. ‘Zodiac Driver Training’ acts as agents for its franchised Instructors and is not responsible for money paid or booking dates and times.
Price Changes
The price of lessons which have not been pre-paid as part of a block booking may be changed at any time.
You will always receive prior notice of such changes.
Cancellations
48hrs notice is normally required to cancel or postpone a lesson, if this is not possible and the lesson cannot be re arranged to a mutual acceptable time within 7 days of the cancelled lesson, at the total discretion of the Instructor, the full training fee for the period in question may be lost or charged.
When your lesson has been booked please look out for your Instructor, He/She will wait at the agreed pick up point for 10 minutes only.
Delays and Postponement by Instructor
Any pupil may be refused a driving lesson if the Instructor has reason to believe that the pupil is under the influence of drink or drugs and the lesson will be charged for at the full amount.
Your Instructor will endeavour to attend your lesson on time, but if delayed the time lost will be made up at the end of the booked lesson time or if not convenient, added on to a future lesson.
If a lesson is postponed or cancelled due to traffic congestion or vehicle breakdown, the Instructor will endeavour to rebook this lesson within a 7 day period on a mutually agreed time and date.
Test
If a pupil has applied for a driving test or the Instructor has applied for a test on their behalf, and does not keep up to date with their lessons prior to test, or if in the opinion of the Instructor, the pupil is not safe to proceed with the test, the Instructor reserves the right to refuse the use of the tuition vehicle for the test.
The Instructor will endeavour to inform the pupil of this intention in good enough time for the test to be rescheduled without loss of test fee.
If the pupil decides to go ahead with the test and fails the driving test, the Instructor will not be liable for any loss of test fees.
No responsibility can be taken for tests cancelled by the DSA due to adverse weather or any other reason.
Nor can your Instructor take responsibility for you losing your documentation or failing an eyesight test. Your Instructor will take responsibility for lost test fees if the test is cancelled due to the condition of the vehicle.
Complaints
Complaints must be made in the first instance to the Instructor concerned. If you are not able to resolve the matter with the Instructor, you may telephone the office 0800 052 1122. As a final step complaints can be put in writing to – Zodiac Driver Training, Head Office, 49 Busticle Lane, Sompting, Lancing, West Sussex BN15 0DJ or by email to zodiacdrivers@hotmail.com. Complaints in writing will only be considered if they are received by the school within 21 days of the incident. Failing agreement or settlement of a dispute, reference may be made to DSA’s Registrar of Approved Driving Instructors:

CODE OF CONDUCT
Personal Conduct
The instructor will at all times behave in a professional manner towards clients
•
Clients will be treated with respect and consideration.
•
The instructor will try to avoid physical contact with a client except in an emergency or in the normal course of greeting
•
Whilst reserving the right to decide against giving tuition, the instructor will not act in any way which contravenes legislation on discrimination.

Business Dealings
The instructor will safeguard and account for any monies paid in advance by the client in respect of driving lessons, test fees or for any other purpose and will make the details available to the client on request.

The instructor on or before the first lesson should provide clients with a written copy of his/her terms of business to include:
- legal identity of the school/instructor with full address and telephone number at which the instructor or his/her representative can be contacted
- the price and duration of lessons
- the price and conditions for use of a driving school car for the practical driving test.
- the terms under which cancellation by either party may take place
- procedure for complaints.

The instructor should check a client's entitlement to drive the vehicle and his or her ability to read a number plate at the statutory distance on the first lesson. When presenting a client for the practical driving test the instructor should ensure that the client has all the necessary documentation to enable the client to take the test and that the vehicle is roadworthy.

Instructors will advise clients when to apply for their theory and practical driving tests, taking into account local waiting times and forecast of clients' potential for achieving the driving test pass standard. The instructor will not cancel or re-arrange a driving test without the client's agreement. In the event of the instructor's decision to withhold the use of the school car for the driving test, sufficient notice should be given to the client to avoid loss of the DSA test fee.

The instructor should at all times, to the best of his or her ability, endeavour to teach the client correct driving skills according to DSA's recommended syllabus.

Advertising
• The advertising of driving tuition shall be honest; claims made shall be capable of verification and comply with codes of practice set down by the Advertising Standards Authority.
• Advertising that refers to clients' pass rates should not be open to misinterpretation and the basis on which the calculation is made should be made clear.
Conciliation
• Complaints by clients should be made in the first instance to the driving instructor/driving school/ contractor following the complaints procedure issued.
• Failing agreement or settlement of a dispute, reference may be made to the DSA's Registrar of Approved Driving Instructors who will consider the matter and advise accordingly.
• Should the Registrar not be able to settle the dispute he or she may set up a panel , with representatives from the ADI industry, to consider the matter further or advise that the matter should be referred to the courts or other statutory body to be determined.
